Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you" or "User") and Care.Life Technologies, Inc. ("Care.Life"), located at 178 W 13490 S, Suite 202, Draper, UT 84020. By accessing or using the Care.Life website (https://www.care.life), the Care.Life mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms and the Care.Life Privacy Policy. If you do not agree, do not use the Platform.

1. Eligibility and Accounts

​

You must be at least 18 years old and able to form a legally binding contract to use the Platform. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration and to keep that information updated.

2. Use of the Platform

​

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Platform in any way that violates applicable law or regulation

  • Attempt to gain unauthorized access to any part of the Platform, other accounts, or related systems

  • Interfere with or disrupt the integrity or performance of the Platform

  • Use any automated means (including bots or scrapers) to access the Platform without Care.Life's written permission

  • Reverse engineer, decompile, or otherwise attempt to derive source code from the Platform

 

3. SMS Communications

​

If you provide your mobile phone number to Care.Life — through the Care.Life online scheduling page, during account confirmation, or directly to a Care.Life representative — and consent to receive text messages, you agree that Care.Life may send you recurring SMS messages related to scheduling confirmations, appointment reminders, account confirmations, customer support, and follow-up communications. Message frequency varies. Message and data rates may apply. You may reply STOP to opt out at any time, or reply HELP for assistance. Care.Life's handling of mobile phone numbers and SMS opt-in data is described in detail in the Care.Life Privacy Policy.

4. Intellectual Property

​

All content, features, and functionality on the Platform — including text, graphics, logos, icons, images, audio, video, software, and the selection and arrangement thereof — are owned by Care.Life Technologies, Inc. or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Platform without Care.Life's prior written consent.

 

5. User Content

If you submit any content to the Platform (for example, comments, feedback, or information related to Residents under your account), you represent that you have the right to do so and grant Care.Life a non-exclusive, royalty-free, worldwide license to use, store, and display that content solely as needed to operate and improve the Platform.

 

6. Third-Party Services

​

The Platform may link to or integrate with third-party services (for example, Calendly for scheduling). Care.Life is not responsible for the content, policies, or practices of any third-party service, and your use of those services is governed by their own terms and privacy policies.

 

7. Disclaimer of Warranties

​

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, CARE.LIFE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CARE.LIFE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

 

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARE.LIFE TECHNOLOGIES, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE PLATFORM. CARE.LIFE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID CARE.LIFE IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

 

9. Indemnification

You agree to indemnify, defend, and hold harmless Care.Life Technologies, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Platform, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual property or privacy right.

 

10. Termination

​

Care.Life may suspend or terminate your access to the Platform at any time, with or without cause and with or without notice, including if Care.Life believes you have violated these Terms. Upon termination, your right to use the Platform will immediately cease. Sections of these Terms that by their nature should survive termination (including Sections 4, 7, 8, 9, and 12) will survive.

 

11. Changes to These Terms

​

Care.Life may update these Terms from time to time. If Care.Life makes material changes, Care.Life will update the "Last Updated" date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

 

12. Governing Law and Dispute Resolution

​

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Platform will be resolved exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.
